Welcome to Huayun Culture and Tourism Group Co., Ltd. (“Company”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your use of our website and, where applicable, your purchase of travel services from us.

By accessing or using our website, contacting our customer service team, or placing a booking request, you agree to be bound by these Terms. If you do not agree, please do not use the website or book our travel services.

1. Use of This Site

You agree to use this website only for lawful purposes and in a manner that does not interfere with our website, our services, or other users.

You may use the website to learn about our tourist train journeys, review route information, and contact us through our official channels.

2. Changes to These Terms

We may update these Terms from time to time. Any updated Terms will apply from the date they are posted on the website unless otherwise stated.

3. Travel Information and Availability

We aim to ensure that the information on our website is accurate and up to date. However, route details, journey dates, schedules, onboard features, and other service information may change without notice.

We offer a range of special train journeys, including:

  • New Oriental Express
  • Shifang Expresss
  • Silk Road Express

Routes and schedules may vary by season and departure period.

3.1 Railway Operations and Force Majeure

Guests acknowledge that railway transportation is essential to the national economy and operates under unified scheduling command by railway authorities.

In cases of unexpected events, network adjustments, track construction, line incidents, vehicle breakdowns, route overlaps, or other force majeure circumstances that cause the chartered train to depart early, be delayed, or be unable to operate:

  • The agency shall provide 7 days’ notice where operation resumes, or 5 days’ notice where the train cannot operate at all
  • The agency bears no liability for breach of contract under such circumstances
  • If the guest agrees to reschedule after consultation, the agency will reimburse reasonable rescheduling fees for guests who have already booked major transportation arrangements

Departure times and stopping points are subject to official railway authority orders and may change without prior notice.

4. Journey Features and Travel Experience

Our special train journeys are designed to offer premium railway tourism experiences.

Depending on the route and train, features may include:

  • Private cabins with en-suite bathrooms
  • 24-hour hot water
  • Dining cars
  • Observation cars
  • Entertainment cars
  • Bar cars
  • Multilingual support
  • Butler-style service
  • Themed dining and cultural experiences

Specific carriages, room types, onboard services, and route experiences may vary by train.

4.1 Altitude and Climate Considerations

Certain routes traverse high-altitude regions. Guests are advised to:

  • Prepare altitude sickness medication in advance, as some destinations are at high elevation
  • Bring sun protection (sunglasses, sun hats, sunscreen, lip balm) due to strong UV exposure on plateaus
  • Prepare for large day-night temperature swings with long-sleeve clothing and warm jackets
  • Carry common medications (cold medicine, stomach medicine, aspirin, etc.)

The plateau environment presents unique challenges; guests with health concerns should consult a physician before travel.

4.2 Local Standards and Environmental Adaptation

Local hotel and dining standards in certain destinations, particularly in western and plateau regions, may differ from standards in inland urban areas. Guests are advised to:

  • Bring common medications for adjustment to new environments
  • Maintain realistic expectations regarding amenities and service levels in remote areas

4.3 Room Assignments

If single guests of the opposite sex are required to share a room, the guide may split them into separate accommodations or arrange an additional bed

Couples will share a room where possible

Single occupancy requires a single room supplement (additional fees apply)

5. Pricing and Payment

Prices shown for our journeys are shown in RMB, unless otherwise stated.

Payment methods for booking include: Visa, Mastercard, Alipay International, and WeChat Pay.

Since tourist special trains are chartered and require the agency to pay performance bonds to railway departments and make hotel deposits in advance, payment terms are strict and non-negotiable once booking is confirmed.

6. Bookings

Bookings are subject to route availability, schedule availability, and applicable travel terms.

Customers may contact exclusive customer service or visit the official website or mini-program to select a route.

A multilingual service team is available to assist with bookings and inquiries.

7. Booking Changes, Cancellations, and Guest Substitutions

7.1 Guest Substitutions

Guests may replace travelers up to three (3) days before departure at no cost. Substitutions are subject to verification and approval by the agency. Pre-booked flights or other non-refundable transportation already purchased on the guest’s behalf are not covered by this provision and may require additional payment.

7.2 Modifications

Travelers may modify their travel arrangements up to three (3) days before departure without incurring penalties, except where airline tickets or other non-refundable transportation has already been purchased on their behalf.

7.3 Cancellations and Refunds

Since chartered trains require the agency to pay performance bonds to railway departments and make hotel deposits in advance, the following rules apply:

  • If a booking is canceled for personal reasons after the travel deposit has been collected, the deposit will be non-refundable
  • The balance must be paid 45 days prior to departure. Failure to pay in full will be considered an automatic forfeit of the deposit

These terms serve as supplementary agreements to the travel contract. In the event of any inconsistency with the main contract, these supplementary terms shall take precedence.

8. Electronic Tickets and Itineraries

E-tickets and itineraries will be sent to your email after payment confirmation.

Please make sure your email address is correct when booking.

9. Customer Service and Customization

Our customers may contact exclusive customer service or use the official website or mini-program to select their route.

Custom arrangements may be available as add-ons, subject to availability, including:

  • travel photography packages
  • private tour guides

Any additional requests are subject to availability and confirmation.

10. Intellectual Property

The content on this website, including text, images, logos, layouts, and train names, is owned by or used by Huayun Culture and Tourism Group Co., Ltd. or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or use our website content for commercial purposes without our prior written consent.

11. Prohibited Conduct

You must not use the website in a way that is unlawful, harmful, misleading, or disruptive.

You must not attempt to interfere with the website, misuse our booking process, or misrepresent your identity when contacting us.

12. Guest Safety and Conduct Requirements

12.1 Guide Compliance

Guests must follow all arrangements made by the tour guide at all times during the journey. Unauthorized departure from the group or participation in independent activities is considered early termination of the contract, and necessary fees will be charged accordingly.

Guests bear full responsibility for any itinerary changes or inability to visit attractions resulting from personal decisions.

12.2 Free Activities

During designated free time when no driver or guide service is provided, guests are solely responsible for their personal safety and the security of their belongings.

12.3 Complaints and Feedback

Any concerns regarding service standards or quality must be raised immediately with the on-site tour guide to allow for prompt resolution. Complaints are primarily assessed based on the feedback form completed at the destination; guests are encouraged to complete the form carefully and thoroughly to protect their rights.

13. Third-Party Services

Our booking process may involve third-party services, such as payment providers or travel-related service providers. We are not responsible for third-party websites, tools, or services that are outside our control.
Your use of third-party services may be subject to separate terms and policies.

14. Disclaimer

To the fullest extent permitted by law, the website and all content, travel information, and service descriptions are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be uninterrupted or error-free, or that all service information will remain unchanged.

14.1 Force Majeure

For delays, cancellations, or losses caused by weather conditions, natural disasters, government policies, military activity, or other circumstances beyond the agency’s reasonable control, the agency bears no fees or legal liability. Where attractions cannot be accessed due to closure, a refund at the negotiated price will be provided. Guests agree to itinerary adjustments as necessary while maintaining service standards.

14.2 Itinerary Adjustments

The agency may adjust the order of attraction visits or modify multi-city itineraries without reducing the number or quality of attractions visited if force majeure circumstances occur, including but not limited to:

  • Avalanches
  • Snow blockades
  • Traffic congestion
  • Strikes
  • Railway scheduling adjustments

If itinerary changes result in an early or late tour conclusion, the agency will refund any unspent fees but bears no further liability.

15. Limitation of Liability

To the fullest extent permitted by law, Huayun Culture and Tourism Group Co., Ltd. will not be liable for indirect, incidental, or consequential losses arising from your use of the website or from circumstances outside our reasonable control.

Nothing in these Terms limits any liability that cannot lawfully be excluded.

16. Health Restrictions and High-Risk Activity Warnings

16.1 High-Risk Activities

Activities including but not limited to: scuba diving, paragliding, skiing, skateboarding, hunting, rock climbing, adventure sports, martial arts, wrestling, horse racing, go-karting, bungee jumping, horse riding, and similar high-risk pursuits are undertaken at the guest’s sole discretion and risk.

Guests should carefully assess their health condition and age before participating in such activities.

Restricted Participants:

  • Minors traveling alone
  • Seniors aged 55 and above
  • Individuals with heart conditions should not participate in high-risk activities.

If the signatory voluntarily joins or participates in such activities, they fully understand the associated risks and bear full responsibility for any injuries, losses, or consequences arising therefrom.

16.2 Medical Disclosures

Guests with the following conditions are advised not to join this tour:

  • Severe heart disease
  • High blood pressure
  • Diabetes
  • Pancreatitis
  • Coronary heart disease
  • Cancer
  • Guests aged 80 years or above

Any concealment of pre-existing health conditions voids the agency’s responsibility, and all resulting costs and consequences shall be borne by the guest.

16.3 Insurance Adjustments

Insurance coverage for guests aged 75 and above or children under 3 years old is adjusted to 50% of normal coverage. Any insufficient insurance payments shall be borne by the guest.

17. Injury, Accident Claims, and Insurance Procedures

In the event of injury or accident during the tour:

  • The local agency will assist with hospital visits and coordinate medical care
  • Insurance claims will be processed in accordance with national procedures and the guest’s applicable policy
  • If a guest refuses on-site medical examination but subsequently completes the full tour, all consequences and costs resulting from such refusal shall be borne by the guest

Guests are encouraged to maintain adequate travel insurance coverage appropriate for the destinations and activities planned.

18. Privacy

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

19. Governing Law

These Terms are governed by the laws of the jurisdiction applicable to Huayun Culture and Tourism Group Co., Ltd. and its business operations.

20. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and Cancellation and Refund Policy, set out the agreement between you and Huayun Culture and Tourism Group Co., Ltd. regarding your use of the website and your booking of travel services, subject always to any rights that cannot lawfully be excluded.

22. Termination

We may refuse service, suspend access, or cancel a booking request where we reasonably believe these Terms have been breached, or where service cannot be provided as planned.
